Who it is for and when to start

It is for companies holding a JTC tenancy or lease that want to change what they do on site. JTC’s change-of-use page sets two conditions: the new use must be compatible with the surrounding industries, and at least 60% of the premises must stay in industrial use under URA’s 60:40 rule.

Start early: JTC advises applicants not to commit to any tenancy or renovation works before receiving its decision. Where JTC’s document list calls for NEA clearance, obtain it first; in our experience JTC does not proceed without it.

What we prepare

  • A check of the proposed use against the 60:40 rule and JTC’s published requirements, judged on what will be done on site, not on the business code the company is registered under.
  • The 60:40 split mapped on the layout before fit-out costs are fixed, with ancillary offices, meeting rooms, showrooms and industrial canteens kept within URA’s 40%, with any showroom on the first storey, as URA requires.
  • The NEA industrial siting submission where the new use is a new industrial activity or process; NEA says none is needed for non-industrial uses such as office.
  • The other documents JTC lists, with the proposed use described the same way in the NEA clearance, the JTC application and the ACRA record, since JTC flags mismatches.
  • Answers to JTC’s queries until it decides, replying to every point and saying plainly where one does not apply.

What you provide

Your lease or tenancy document, any letters or approvals from JTC, and a short note of what you want to do and by when. We will tell you what else JTC is likely to ask for.

For a change of use, that includes a precise description of the new activity; the 60:40 check also needs the layout of the premises. JTC lists clearances from NEA’s Development Control and Licensing Department and, where relevant, an LTA land use proposal form for warehousing, a significant increase in traffic or a new or intensified factory-converted dormitory, and SCDF approval where petroleum or flammable material above the allowed quantities will be stored. For an NEA industrial siting consultation, NEA asks for details such as a process flowchart, materials, and pollution control and fuel-burning equipment.

  2. Structure We shape the case — the angle, the evidence, the fit to policy — before a single form is filed. For a change of use, that means settling the use first: what the new activity is, and a layout that keeps at least 60% in industrial use.
  3. Submit We prepare the complete submission in your company’s name, for your director to sign, built to be read. Applications go through JTC’s Customer Service Portal, with the NEA and other agency clearances.
  4. Follow through We answer JTC’s queries and keep the application moving until JTC decides.

Do I also need planning permission from URA?

Often. URA says development and building works, including a change in how premises are used, need planning permission unless they are on its Exemption List or its list of authorised works. For premises leased from JTC, URA asks for JTC’s letter of consent as landowner, so its application follows JTC’s decision. We advise on when it is needed.
